Welcome to Midwest Siteworks ("Company," "we," "our," or "us"). By accessing or using the Midwest Siteworks website, services, forms, applications, or related platforms (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not access or use our Services.

1. About Midwest Siteworks

Midwest Siteworks operates as a lead generation and contractor referral platform that connects homeowners, property owners, and businesses seeking sitework-related services with independent third-party contractors. Midwest Siteworks does not perform construction services, excavation services, grading services, drainage services, retaining wall construction, or any other physical construction work unless expressly stated in a separate written agreement. Midwest Siteworks is not a contractor, subcontractor, engineer, architect, surveyor, or construction manager.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use the Services. By using the Services, you represent and warrant that: you are at least 18 years of age; all information provided is accurate and truthful; and you have authority to submit information regarding the property or project described.

3. Requesting Quotes

Users may submit project requests through our website. By submitting a quote request, you authorize Midwest Siteworks to: review your project information; share your information with one or more independent contractors; and contact you by phone, email, text message, or other communication methods regarding your project. Submitting a request does not guarantee: contractor availability, project acceptance, project completion, pricing accuracy, or contractor response.

4. Contractor Relationships

All contractors using the platform are independent businesses. Midwest Siteworks does not employ, supervise, control, or manage contractors. Any agreement entered into between a user and a contractor is solely between those parties. Midwest Siteworks is not responsible for: contractor performance, workmanship, delays, damages, contract disputes, payment disputes, permit issues, licensing issues, insurance claims, or project outcomes. Users are solely responsible for conducting their own due diligence before hiring any contractor.

5. No Warranties Regarding Contractors

While Midwest Siteworks may collect information from contractors, we do not guarantee: licensing status, insurance coverage, qualifications, experience, professional certifications, background checks, or compliance with applicable laws. Contractors may represent themselves as licensed or insured, but users should independently verify all credentials before hiring.

6. Contractor Applications

Contractors applying to participate in the Midwest Siteworks network agree that: all submitted information is accurate; they possess all licenses required by law; they maintain required insurance coverage; and they comply with all applicable federal, state, and local laws. Midwest Siteworks reserves the right to accept, reject, suspend, or remove any contractor at any time and for any reason. Participation is not guaranteed.

7. Communication Consent

By submitting any form through the Services, you expressly consent to receive communications from Midwest Siteworks and its contractor partners, including: phone calls, emails, SMS text messages, automated communications, appointment reminders, and quote-related communications. Message and data rates may apply. Consent is not a condition of purchase. You may opt out at any time by following the instructions provided in communications.

8. Intellectual Property

All content on the Services, including but not limited to: logos, branding, text, graphics, images, software, website design, and databases, is owned by Midwest Siteworks or its licensors and is protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, or modified without prior written permission.

9. Prohibited Uses

Users may not: submit false information, impersonate another individual, use automated tools to access the Services, interfere with website functionality, upload malicious code, attempt unauthorized access to systems, or use the Services for unlawful purposes. We reserve the right to terminate access for violations of these Terms.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MIDWEST SITEWORKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF INFORMATION, CONTRACTOR PERFORMANCE, AND UNINTERRUPTED WEBSITE OPERATION. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE OR AVAILABLE AT ALL TIMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDWEST SITEWORKS SHALL NOT BE LIABLE FOR: INDIRECT DAMAGES, INCIDENTAL DAMAGES, SPECIAL DAMAGES, CONSEQUENTIAL DAMAGES, LOST PROFITS, PROPERTY DAMAGE, PERSONAL INJURY, PROJECT FAILURES, OR CONTRACTOR MISCONDUCT. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless Midwest Siteworks and its owners, officers, employees, contractors, affiliates, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from: your use of the Services, your violation of these Terms, any dispute between you and a contractor, or any project performed by a contractor.

13. Third-Party Links and Services

The Services may contain links to third-party websites or services. Midwest Siteworks does not control and is not responsible for third-party websites, products, services, or content. Accessing third-party resources is done at your own risk.

14. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of information as described in our Privacy Policy.

15. Modifications to the Services

Midwest Siteworks reserves the right to modify, suspend, or discontinue any portion of the Services at any time without notice. We are not liable for any modification or discontinuation.

16. Changes to These Terms
